Sergio Cotta (1920-2007) was a hero of the Italian resistance movement during World War II and a lecturer at the University of La Sapienza in Rome. His scientific interests included the philosophy of law, political philosophy, and the history of political thought. He was one of the main figures of Italian intellectual life in the second half of the 20th century. In his research work, he undertook considerations on natural law, proposing a completely new concept of law as a phenomenon closely related to human existence, aimed at creating relationships with others within a community to achieve the common good.
His most famous works include: "Prospettive di filosofia del diritto" (1974), "Giustificazione e obbligatoriet delle norme" (1981), "Il diritto nell'esistenza. Linee di ontofenomenologia giuridica" (1985). "Positive Law and Natural Law", published in this study, is a modified version of a paper presented by Cotta in 1979 at the IX World Congress of Legal and Social Philosophy in Basel. Cotta looks at the complex relationships between natural law and positive law in an original way, seeking harmony and continuity between these two seemingly contradictory concepts.
