LEGAL STATUS OF THE VOIVODESHIP MARSHAL - ZDZISŁAW SOBCZAK JACEK

The book "Legal Status of the Voivodeship Marshal" analyzes the evolution of the marshal's position in the context of the changing system of local government in Poland. The author, Dr. J. Sobczak, emphasizes the impact of decentralization and centralization on the role of the marshal, as well as its growing importance in European cooperation. The reviewer, Prof. Dr. habil. Mirosław Granat, notes that this work is a keen observation of Polish political life and calls for a statutory shaping of the marshal's formal position.

This work analyzes in detail how the changing position and tasks of the voivodeship as a self-government unit affect the legal status of the marshal. The author points to two main prerequisites for this evolution. Firstly, he sees the marshal in the context of the opposing development tendencies of Poland: decentralization and centralization. The strengthening of one of these tendencies has a direct impact on the legal position of the voivodeship marshal. The author notes that in the legislative practice of recent years, the tasks of the voivodeship self-government are limited in favor of government administration bodies, which affects the marshal's position. Examples of these legal solutions are discussed in detail in the individual chapters of the work.

Secondly, with the growing importance of voivodeships as regions, the position of the marshal in the mechanism of European cooperation also grows. The marshal, to whom the laws have entrusted the implementation of decentralized development policy, becomes a key figure in this cooperation. Observations on the functioning of self-government confirm this thesis, which leads to the de lege ferenda postulate, i.e. a statutory shaping of a clear, formal position of the marshal as the sole executive body of the voivodeship self-government.

This book is a valuable source of knowledge for all those interested in the functioning of local government in Poland, as well as for those who want to understand the role and legal status of the voivodeship marshal in a political and legal context. This publication is an important contribution to the discussion on decentralization and centralization in Poland, as well as on the role of regions in European cooperation.
