The author focuses on finding the optimal model for verifying the evidentiary activities of law enforcement agencies from the perspective of judicial control of preparatory proceedings. He proposes a broad view of this control, including aspects that are relevant from the point of view of the Constitution and the European Convention on Human Rights. He formulates a number of postulates related to legislative changes aimed at implementing the verification model constructed by him. The formulated theses and proposals for changes are supported by a comprehensive analysis, which also takes into account a broad comparative legal background (English and German solutions). The study aims to develop a satisfactory standard for the protection of human rights.
This publication aims to minimize irregularities and abuses in the use of evidentiary activities and to unify the interpretation and practice of applying the law of evidence in preparatory proceedings. The author presents a proposal of assumptions that may contribute to achieving this goal. The verification of these activities is a tool that is intended to strengthen the reliability of criminal proceedings by granting the judge for preparatory proceedings the exclusive competence to perform them. In addition, the subject of assessment is the purposefulness (reasonableness), necessity, proportionality and adequacy of carrying out a given activity, and not only the examination of the correctness of the evidentiary activity. This is to lead to finding a balance between prosecuting the perpetrator, the need to collect incriminating evidence and guaranteeing fundamental rights and freedoms of citizens.
