The monograph "Legal Transplants" is the result of research conducted by the Author as part of his doctoral dissertation. The work focuses on the introduction of solutions from Anglo-Saxon systems (common law) into the Polish legal system. The author adopts the perspective of the comparative law paradigm of legal transplants, the beginning of which was the work of Alan Watson.
The nature of legal transplants is uncontroversial. It is questionable what happens to a legal solution when it is transferred to another legal system and in the course of further legal development. In practice, the question arises as to how to make a transplanted solution "work" in a new environment and how to adapt it. Legal transplants between very different legal systems belonging to different legal traditions are particularly interesting.
In the absence of a comprehensive monograph on this topic, the aim of the publication was to identify the mechanisms of such legal transplants and to assess their effectiveness against certain criteria. The research was based on studies of ten legal solutions, including: partnership, business judgment rule, registered pledge, Anglo-Saxon contract models, group proceedings, disclosure (issuance) of evidence, written testimony, amicus curiae opinion, mediation in criminal cases, and proposals to introduce peace courts into the Polish legal system.
The publication may prove to be a valuable source of information and inspiration not only for representatives of legal sciences, but also for people involved in legislative processes, as well as legal practitioners.
